Un t\u00edtulo de &quot;gerente&quot; o el pago de un salario no descalifica autom\u00e1ticamente a un empleado para la compensaci\u00f3n por horas extras, descansos o per\u00edodos para comer. Los empleados deben cumplir con requisitos muy espec\u00edficos para estar exentos de horas extras y per\u00edodos de descanso y comida.<\/li>\n<li>Tener que trabajar durante los per\u00edodos de comida o que se le nieguen los descansos.<\/li>\n<li>Ser compensado por trabajo a destajo y no recibir una compensaci\u00f3n adecuada por los descansos y el tiempo no productivo.<\/li>\n<li>Ser clasificado incorrectamente como un &quot;contratista independiente&quot; para que su empleador pueda evitar pagar ciertos impuestos y cumplir con ciertas leyes federales y estatales, como compensar a los empleados con salarios m\u00ednimos y horas extra.<\/li>\n<\/ul>\n<p>O su empleador tiene el h\u00e1bito de:<\/p>\n<ul>\n<li>No pagarle a usted y a otros empleados a comisi\u00f3n un salario m\u00ednimo o horas extras, \u00fanicamente porque se les paga a &quot;comisi\u00f3n&quot;.<\/li>\n<li>No proporcionarle a usted y a otros empleados a destajo descansos y comidas adecuados, \u00fanicamente porque se les paga &quot;por pieza&quot;.<\/li>\n<li>No compensarlo por el tiempo de vacaciones acumulado al momento de la terminaci\u00f3n.<\/li>\n<li>No pagarle puntualmente despu\u00e9s de la rescisi\u00f3n.<\/li>\n<li>Obligarlo a usted u otros a firmar un documento que pretende liberar al empleador de todos los posibles reclamos. Muchos de estos comunicados son nulos.<\/li>\n<li>Reclasific\u00e1ndolo como \u201cno exento\u201d y cambiando su estructura salarial, sin pagar salarios atrasados.<\/li>\n<li>Exigirle que realice un trabajo &quot;fuera de horario&quot;
